Terms of Service
In short
- Opzo provides software. Each driving school runs its own business and is responsible for its lessons, prices and dealings with students.
- Schools own their content and data; we host it to provide the service.
- Online payments are processed by Stripe, and paid out to schools less agreed fees.
- Nothing in these terms takes away your rights under the Australian Consumer Law.

1. About these terms
These terms are between you and Opzo Pty Ltd ("Opzo", "we", "us"). They apply when you use opzo.com.au, the Opzo Drive app at app.opzo.com.au, a driving school website we host, or the Opzo Admin mobile app. By creating an account or using the service, you agree to these terms and to our Privacy Policy.
If you use Opzo on behalf of a business, you confirm you're authorised to accept these terms for it.
2. The service
Opzo Drive gives driving schools:
- a website;
- online booking and payments;
- trainer and vehicle scheduling;
- student records;
- reviews;
- reports;
- related tools.
Features may depend on a school's plan. Free trials end as described when you sign up.
Opzo is a software provider. We don't provide driving lessons, and we aren't a party to the agreement between a school and its students.
3. Accounts and security
- Give accurate information and keep it up to date.
- Keep your password private. You're responsible for activity on your account.
- Tell us straight away at info@opzo.com.au if you think your account has been misused.
- For security, signed-in sessions end after 15 minutes without activity.
4. Driving schools' responsibilities
A school using Opzo is responsible for:
- its lessons, prices, cancellation and refund policies, and the accuracy of what it publishes;
- holding and keeping current any licences, accreditations, insurance and registrations its business and trainers need, and following road transport, consumer, employment and privacy laws;
- having a lawful basis, and any consent needed (including from parents or guardians of students under 18), for the personal information it enters about students and trainers;
- the actions of its staff and trainers who use Opzo;
- keeping its own copies of anything it needs. Schools can ask us for an export of their records.
5. Students and bookings
When you book through a school's website, your booking is with that school, on the school's terms. That includes its cancellation and refund policy. Questions about a lesson, trainer, refund or result go to the school. We'll help where we can.
6. Payments, fees and payouts
- Online payments are processed by Stripe. By paying or receiving payments you also agree to Stripe's terms. We don't store full card numbers.
- Where Opzo collects online payments for a school, we pay them out to the school's nominated account on the agreed schedule, less Opzo's agreed commission and any refunds, chargebacks or adjustments. Schools complete Stripe's identity and bank checks before payouts can be made.
- Subscription fees, if any, are shown when you choose a plan and are charged in advance. They're not refundable for partial periods, except where the law requires.
- Prices include GST where it applies.
- Refunds to students are made under the school's refund policy. If a chargeback is lost or a refund is made after a payout, the amount may be recovered from future payouts.
7. Content and websites
- Schools keep ownership of their content: text, images, logos, lesson details and data.
- Each school gives Opzo a licence to host, copy, display and adapt that content, only as needed to run its website and provide the service.
- Schools must have the rights to what they upload, and it must not be false, misleading, defamatory or unlawful.
- Website templates and the Opzo software remain ours. Schools may use them while subscribed.
- A school using its own domain is responsible for the domain registration and its DNS settings.
- Reviews shown on a school's website, including reviews from Google, must be genuine. Schools must not create or alter reviews to mislead.
8. Acceptable use
Don't:
- break the law or anyone's rights;
- send spam;
- try to access other people's accounts or data;
- probe, overload or interfere with the service;
- copy or resell the software;
- use Opzo to process payments for anything other than genuine driving-school services.
9. Third-party services
Some features rely on other providers: Stripe for payments, Google for sign-in, Calendar, Maps and reviews, and email delivery services. Their availability and terms are outside our control. Connecting a Google service is optional, and you can disconnect at any time.
10. Availability and changes
We work to keep Opzo available and back it up daily. We can't promise it will always be uninterrupted or error-free, for example during maintenance or problems with our providers. We may improve or change features. If a change significantly reduces what a paying school receives, we'll give reasonable notice.
11. Suspension and cancellation
- A school can cancel at any time. Its website goes offline, and it can ask us to export or delete its data. We keep records the law requires.
- We may suspend or close an account for serious or repeated breaches of these terms, unpaid fees, fraud, or to protect people or the service. Where reasonable, we'll give notice first and a chance to fix the problem.
- Sections that by their nature should continue after cancellation (such as payments owed and liability) continue.
12. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, that can't be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
To the extent the law allows:
- Where our liability for a failure to comply with a consumer guarantee can be limited, it's limited to supplying the services again or paying the cost of having them supplied again.
- We aren't liable for indirect or consequential loss, or for loss of profits, revenue or data, that arises from using the service.
- Our total liability to a school in any 12 months is limited to the fees it paid us in that period.
We aren't responsible for the conduct of driving schools, their trainers or students, or for lessons and driving tests.
13. General
- We may update these terms. We'll post the new version here with its effective date, and tell account holders about significant changes. Continuing to use Opzo after that means you accept them.
- These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction.
- If part of these terms can't be enforced, the rest still applies.
